DISPUTE RESOLUTION

Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation, and arbitration.

FAMILY DISPUTES

Family Mediation is a process of assisting parties in a dispute resolve their conflict with the assistance of a neutral party.  Families experiencing disputes and conflicts are encouraged to use family mediation as an alternative to a court proceeding where "dirty laundry" is being aired in a public setting.  Family mediation allows the dispute to be resolved with inputs from each party, while in a court setting the judge settles the dispute.

MANAGEMENT AND EMPLOYEE DISPUTES

Management and employee mediation is a way of settling internal disputes which arises between employees and management.  The process identifies conflict and create a productive workplace environment. It differs from disciplinary and grievance procedures by encouraging a alternative dispute process where disputants engage collaboratively with the assistance of a neutral third party.

PROPERTY DISPUTES

Mediation is often used in property disputes. It is an ideal way for parties to take control of their dispute and reach a decision which is beneficial to both parties. Taking control back from the court and thinking of options outside of the usual orders that a court can make is a very attractive option to those involved in property disputes.

MORTGAGE DISPUTES

Mediation is a non-binding process where the parties, the Borrower and Lender, attempt to find a mutually acceptable resolution to their dispute with the help of a neutral person called the Mediator.

TENANT & LANDLORD DISPUTES

Tenant & Landlord mediation is a process where both parties can contribute to the resolution of the dispute. This process reduces cost and helps foster better tenant and landlord relations.

CUSTOMER RETENTION

One of the most effective forms of marketing is Word of Mouth. Conflict is inevitable and every business must create a cultural where their internal and external customers become their biggest fans.  We train for-profit and non-profit companies staff on how to welcome and use conflict as a building block to create a culture where internal and external clients become Raving FANS.

COLLABORATIVE SERVICES

Collaboration is a dispute-resolution method by which parties and their attorneys settle disputes using nonadversarial techniques to reach a binding agreement, with the understanding that if the parties cannot agree and choose to litigate instead, the attorneys involved in the negotiations will be disqualified from representing them any further.

BUSINESS DISPUTES

Business mediation is a method of conflict resolution that seeks to preserve the external relationships between businesses and their customers.  Instead of pitting the parties against each other, as courtroom litigation can, business mediation works to make the parties partners in finding a solution.

PARTNERSHIP DISPUTES

Mediation: It is the process where an independent mediator is appointed to resolve the dispute. The mediator does not decide the dispute, but attempts to make a fair discussion. It is a very cost effective way of resolving a dispute, while giving an option to the parties to provide inputs for resolution of matters.

GUARDIANSHIP DISPUTES

By taking your guardianship dispute through mediation, you set the tone for your relationship with all parties going forward. Because the process can be far less antagonistic, the true objective of the dispute is brought to light – and that is the best interest of the ward or the child.

FAITHBASED DISPUTES

Faith-based mediation is a complex process that dynamically integrates three dimensions: the technical one, involving knowledge and skills for the mediation element itself; the humane one, which is based on the ability to recognize personal, emotional, and relational elements in the conflict, to promote better understanding between the conflicting agents and foster solutions seeking; and the transcendent one, which relies on the religious belief system and pursues divine intervention into the dispute to move the parties from conflict to reconciliation and peace-making.
